EU requests consultation with UK on sandeel fishing

On April 16, 2024, the EU formally requested consultations with the UK regarding its decision to prohibit sandeel fishing. This request is made under the framework of the EU-UK Trade and Cooperation Agreement (TCA), which emphasizes the use of evidence-based, proportionate, and non-discriminatory measures for marine resource conservation.

Starting from March 26, 2024, the closure of sandeel fishing encompasses English waters in the North Sea and all Scottish waters. This action significantly limits EU vessels’ access to this fishery. The EU seeks clarification on whether the complete and permanent closure aligns with the principles and obligations outlined in the TCA.

Initiation of consultations under the TCA dispute settlement mechanism marks the formal beginning of proceedings aimed at resolving the disagreement. Both parties now have 30 days to seek a mutually acceptable resolution.

EFFOP have actively contributed to prior consultations with the UK and Scottish authorities. The decision to close the sandeel fishery will have a significant impact on both EU fisheries and European aquaculture production in countries such as Norway, Scotland, and others. European Sandeel fishing has historically been pivotal for the global fishmeal market, supporting industries reliant on fish-based products.

EFFOP appeals both the UK and the Scottish governments to adhere to the available scientific evidence, which demonstrates that there is no clear evidence of negative or positive effects resulting from the closure of forage fisheries. The EU’s request for consultations underscores the importance of adopting a scientifically and legally sound approach to fisheries management.
